案例一案情介绍（文中姓名都是化名）2003年3月17日晚，武汉青年孙志刚因为没有暂住证，被广州警方查出。在收容期间，救治站护工指使8名被收治人员对之两度轮番殴打致孙志刚死亡。后来法医鉴定，孙志刚系因背部遭受钝性暴力反复打击，造成大面积软组织损伤致创伤性休克死亡。涉案12名案犯已分别被判刑，20名公安系统、卫生系统、民政系统的相关人员也受到相应的处罚。但是此案引起了对收容遣送制度存在问题的广泛关注。案发后不久，三名法学博士以“中国公民”的名义，对收容制度提起违宪审查。5月14日，一份题目为“关于审查《城市流浪乞讨人员收容遣送办法》的建议书”，传真至全国人大常委会法制工作委员会：“全国人民代表大会常务委员会：《中华人民共和国立法法》第88条第2款规定，全国人大常委会有权撤销同宪法和法律相抵触的行政法规。第90条第2款规定，公民认为行政法规同宪法或法律相抵触的，可以向全国人大常委会书面提出进行审查的建议。建议人在落款处签名：中华人民共和国公民：俞江，华中科技大学法学院；腾彪，中国政法大学法学院；许志永，北京邮电大学文法学院。和一般的公民向人大常委会提出制定、修改法律的建议不同，这份公民建议书非同寻常之处在于，是公民依照《立法法》规定，向全国人大常委会提出对有关法规进行违宪审查的创举。可以说，这份薄薄的公民建议书，以民间形式启动了要求全国人大常委会行使违宪审查权的程序，罕有先例。2003年6月20日，国务院发布第381号令，《城市生活无着的流浪乞讨人员救助管理办法》自2003年8月1日起施行，1982年5月国务院发布的《城市流浪乞讨人员收容遣送办法》同时废止。新办法提出全新的自愿救助原则，取消了强制手段,违宪审查也自然终止。法律问题公民是否有权向全国人大常委会提出对有关法规进行违宪审查？
