泰嘉贸易公司从国外购进100吨钢材，委托某船运公司运往中国境内。一日，该船运公司一艘夹载着该船船员私自在国外购买的500多件电器等物的船，在中国海口市担杆岛附近海域进行走私交易时，被中国某海关抓获。该海关作出决定，将包括该贸易公司100吨钢材在内的船上所有物品予以没收。该贸易公司与海关交涉，要求返还100吨钢材未果。对此，该贸易公司向该海关所在地中级人民法院提起诉讼，并向人民法院提供了合法购运100吨钢材的证据，要求人民法院撤销被告没收财产的处罚决定，并要求被告返还100吨钢材。中级人民法院受理了此案。被告认为自己所作的没收处罚决定是对走私货船而不是对贸易公司的，贸易公司与被告不存在法律上的利害关系，不具有原告资格。在诉讼期间，被告撤销了没收贸易公司物品的决定，但被告称：船运公司货船走私一案已经市公安局批准立为刑事案件，正进行侦查，对贸易公司的钢材是不是走私货物还未确定，所以不能返还。对此案，人民法院应当如何处理？
